Reality wins again: KSM to be tried by military tribunal

CBS News: Attorney General Eric Holder today announced that self-proclaimed Sept. 11 mastermind Khalid Sheikh Mohammad and his four alleged co-conspirators will be tried in a military commission, as the CBS News Investigative Unit reported earlier today. A source tells CBS News the commission will be held at the Guantanamo Bay prison.

Today's announcement represents a pronounced shift in the administration's handling of terrorism cases. Trying Mohammad in a civilian court and closing the Guantanamo prison were once some of the Obama administration's top priorities, but political realities have hamstrung both goals.

Holder said today that he still believes the federal court system would have provided the best court system. The Justice Department today unsealed the indictment against the accused 9/11 plotters in December 2009, which Holder said revealed "we were prepared to bring a powerful case against Khalid Sheikh Mohammad."

"I continue to think the Article 3 courts are the best place to bring" the accused terrorists to trial, he said. However, he added, justice for the victims of 9/11 has been "long overdue and must not be delayed any further." [MORE]
So Gitmo won't be closing and KSM will not get a civilian trial. Reality 2, Obama administration 0. Closing Gitmo and holding civilian trials for enemy combatants were never really doable. There were some very sticky issues that made doing both pretty much impossible.

I think the main reason the left took to these ideas had more to do with being reflexively anti-Bush rather than a thoughtful position. If Bush was for A, the the left was for B. Standing in opposition to everything is easy to do when you are not in the drivers seat. However, when you are forced to live with the consequences and actually attempt the executions of these opposing ideas, reality starts to intrude.

Despite the setback the left will feel over this, I doubt it will hurt Obama with his base. If anything, giving up civilian trials may help Obama with independents.

The real sad part about all of this is the complete waste of time and money spent trying to bring a bad idea to life.

Retreat? Obama advisers to recommend military tribunals for KSM


The Washington Post has a big scoop today. It is reporting that Obama’s advisers are going to recommend that Khalid Sheikh Mohammed be tried under a military tribunal. 
From The Washington Post: President Obama's advisers are nearing a recommendation that Khalid Sheik Mohammed, the self-proclaimed mastermind of the Sept. 11, 2001, attacks, be prosecuted in a military tribunal, administration officials said, a step that would reverse Attorney General Eric H. Holder Jr.'s plan to try him in civilian court in New York City.
The president's advisers feel increasingly hemmed in by bipartisan opposition to a federal trial in New York and demands, mainly from Republicans, that Mohammed and his accused co-conspirators remain under military jurisdiction, officials said. While Obama has favored trying some terrorism suspects in civilian courts as a symbol of U.S. commitment to the rule of law, critics have said military tribunals are the appropriate venue for those accused of attacking the United States.
If Obama accepts the likely recommendation of his advisers, the White House may be able to secure from Congress the funding and legal authority it needs to close the U.S. military prison at Guantanamo Bay, Cuba, and replace it with a facility within the United States. The administration has failed to meet a self-imposed one-year deadline to close Guantanam
What is interesting to note is that they are doing this for political reasons rather than listening to the will of the people or accepting the logic behind military tribunals. The WaPo story goes on to show that the administration has not completely given up on civilian courts or closing Gitmo.

To close the detention center at Guantanamo, the administration needs funding to acquire and refurbish a prison in the United States, probably a state-owned maximum-security facility in Thomson, Ill. Because Congress has barred the transfer to the United States of all detainees except those destined for prosecution, the White House needs legal authority to move prisoners it plans to hold in some form of indefinite detention.
An interagency review of all cases at Guantanamo Bay concluded that about 50 prisoners will have to be held in some form of prolonged detention without trial, because the evidence against them was obtained through the use of harsh interrogation methods or because its revelation in court would compromise intelligence gathering. The government says the detainees are too dangerous to release. 
One would think that having to borrow $1.6 trillion for the budget, the idea of spending money to hold civilian show trials would be off the radar. Something tells me that we will be seeing a retreat on this front as well.

The liberals are going to go absolutely bananas over this decision and the WaPo story makes note of that as well. 
Privately, administration officials are bracing for the ire of disappointed liberals and even some government lawyers should the administration back away from promises to use civilian courts to adjudicate the cases of some of the 188 detainees who remain at Guantanamo. 
Obama is going to have to throw liberals a major bone after this retreat. Liberals have had to sacrifice a lot under Obama.  Liberals are not getting a public option in health care reform, no cap and trade legislation, no immediate withdrawal from Iraq or Afganistan and now this.  If Obama has wants any hope of liberals being energized for him in 2012, he is going to have to give liberals a major something something soon.

Eric Holder is also not going to like this decision. He was the one who came up with the idea of holding the KSM trial in NYC in the first place. Should Obama override him on this, Holder will look as clownish as Napolitano. This retreat on  KSM comes right after having to give up the names of the Al Qaeda 7 too. My guess is that if Holder stays on, we will be hearing far less from him.

Obama to help pick new location for KSM trial



The Washington Post is reporting that Obama is going to involve himself with picking a location for the KSM trial: 
President Obama is planning to insert himself into the debate about where to try the accused mastermind of the Sept. 11, 2001, attacks, three administration officials said Thursday, signaling a recognition that the administration had mishandled the process and triggered a political backlash.
Obama initially had asked Attorney General Eric H. Holder Jr. to choose the site of the trial in an effort to maintain an independent Justice Department. But the White House has been taken aback by the intense criticism from political opponents and local officials of Holder's decision to try Khalid Sheik Mohammed in a civilian courtroom in New York.
Administration officials acknowledge that Holder and Obama advisers were unable to build political support for the trial. And Holder, in an interview Thursday, left open the possibility that Mohammed's trial could be switched to a military commission, although he said that is not his personal and legal preference.  
This is one of the biggest problems with this administration. They are far too concerned with politics than governing. The article makes clear that a civilian trial is Holder’s personal and legal preference, not an absolute necessity. So why go to battle over this? Since Holder now seems ambivalent about civilian trials vs. military tribunals, save everyone the grief and just have the military tribunals, unless of course, you are more concerned about the politics of backing down under opposition pressure than doing the right thing.

I just have to point out this part of the article [emphasis added, mine]: 
Administration officials said the president's involvement has to do with securing congressional funding for the costly trial before bipartisan efforts to strip financing for the case against Mohammed and four alleged co-conspirators gain greater momentum. They said it was a matter of national security, not just politics. 
When will Obama finally understand that money is tight right now?  Why must he waste money we don’t have on civilian show trials?  The cost of the trials alone should have been a signal to this administration that this was the wrong way to go.

White House to DOJ: Find another location for KSM trial



The White House has asked the Department of Justice to find another venue for the Kahlid Sheikh Mohammed trial. After New Yorker backlash and Mayor Mike Bloomberg coming around, the White House has changed its tune.

The White House ordered the Justice DepartmentThursday night to consider other places to try the 9/11 terror suspects after a wave of opposition to holding the trial in lower Manhattan.
The dramatic turnabout came hours after Mayor Bloomberg said he would "prefer that they did it elsewhere" and then spoke to Attorney General Eric Holder.
"It would be an inconvenience at the least, and probably that's too mild a word for people that live in the neighborhood and businesses in the neighborhood," Bloomberg told reporters.
"There are places that would be less expensive for the taxpayers and less disruptive for New York City." MORE
Keep in mind that they still want to try the 9/11 suspects in American civilian court, but not in NYC.

I think this reversal has everything to do with politics and the aftermath of the Scott Brown victory. Public opinion was running high against having the trial in NYC. Yesterday when Sen. Kristen Gillbrand and Rep. Nydia Velazquez both came out against having the trial in NYC, I knew the tide might be turning. Obama and the Democrats must be fearful that New Yorker’s anger over the trial could have easily set the stage for another Massachusetts like upset in 2010.

Now the big question becomes, where are they going to move these trials to? If the Democrats fear another blue state stronghold upset, could they be so bold as to foist these trials on a red state where they already expect to lose?

Coming To America: Khalid Sheikh Mohammed to have trial in NYC




The Wall Street Journal is reporting that Khalid Sheikh Mohammed, mastermind of the 9/11 attacks, is to stand trial in New York Federal court.
Khalid Sheikh Mohammed, self-described mastermind of the attacks, and four others will be tried in New York federal court. Attorney General Eric Holder said Friday he expects to order prosecutors to seek the death penalty in the five cases.
Five other detainees held at the prison, including Abd al-Rahim al-Nashiri, alleged to have planned the 2000 bombing of the USS Cole, will be tried in revamped military commissions, the Justice Department announced. MORE
This is basically another step in transforming the war on terror into a police operation. The risks are pretty high all around. First, lets be honest, our civilian court system can be used and abused. We see it everyday as enterprising lawyers get winning verdicts for the undeserving simply by clouding the waters.  

Should Mohammed get off on some technicality or by the law working against the government’s case (see Anne Althouse), the American people will be beyond outraged.

Finally, in light of Maj. Nidal Malik Hasan, I would like to ask, what safeguards are being made to make sure Khalid Sheikh Mohammad is not allowed to spread any of his jihad nonsense to those he comes in contact with here in America? A seed planted by Mohammed today could become another attack on America tomorrow.
