Judge stops ban on ACORN funding

From The Hill:

A federal judge today issued an injunction preventing the implementation of a congressional ban on funding for ACORN.
Judge Nina Gershon concluded that the ban amounted to a "bill of attainder" that unfairly singled out ACORN.
"[The plaintiffs] have been singled out by Congress for punishment that directly and immediately affects their ability to continue to obtain federal funding, in the absence of any judicial, or even administrative, process of adjudicating guilt," Gershon wrote in her decision.
Gershon said ACORN had demonstrated "irreperable harm" from the ban, while "the potential harm to the government, in granting the injunction, is less."
The decision noted that the ban had already prevented ACORN from receiving payment from contracts awarded before the ban took effect.
"The public will not suffer harm by allowing the plaintiffs to continue work on contracts duly awarded by federal agencies, which was stopped solely by reason of [the ban]," Gershon wrote.

Basically, until ACORN is fully investigated and charges are brought against them, they will continue to suck off the public tit and feed their corruption. Chances of Eric Holder dropping the boom on ACORN ... zilch!
This is another clear example how government no longer works for the public interest, but instead works for interest groups. How is it that a nation that is borrowing half the money it spends can afford to waste a dime on questionable entities? We all know that the Obama administration is deeply tied to ACORN, so any attempt by this administration to go after ACORN will be half hearted as best. They will do just enough to look like they are on the people's side.
Watch, Eric Holder will find some flimsy excuse not to give ACORN the deep probe it so richly deserves and Obama will take a hands off approach to Holder's decision. A classy dog and pony show.

Eric Holder, Obama, the judge, and ACORN are collaborating and screwing the American people. They are covering up the truth and aiding corruption. ACORN is keeping all these people in their back pocket. They are playing the public for fools, and unfortunately, some people are buying into to it, because they are so blind to the facts, and they just don't want to face the truth. We must continue the fight to bring to light the truth about this corrupt administration.

Perhaps the judge needs to review the videos of ACORN workers telling undercover film-makes how to smuggle in girls. That might change her mind.
Aww, who am I kidding?

If memory serves me correctly, Andrew Breitbart has more to come on ACORN.......and that could provide all kinds of fireworks if the timing is right. Any guesses when he might release some information?

Sadly, the judge is correct. They can't pass a law that singles out one person or group. It is unconstitutional. Now, we can push congress not to give anymore money. Although with the current make up of the congress that is not likely.

They knew that when they filed the injuction. They are not stupid.

This is ridiculous. Whatever minimal criteria ACORN met to get funding has been cancelled by their culture of corruption. The judge's decision is damaging to America.

This is the same judge who said that Mayor Guiliani had to keep the Piss-Christ and Cow-Dung Madonna art show open in the Brooklyn Museum.

She is very literal.

I wonder what Judge Gershon thinks of Acorn in general. Her parents were Holocaust survivors. I wonder if Gershon ever wonders what the U.S. will be like when Acorn gets to harass voters and beat them up at the polls.

Ideas and actions have consequences.

CLifton,

Well, here is the one downer on a glorious Sunday evening here in La-La-land. Not your reportage, of course, it's always spot on!

I mean the reminder that this and the bill bawney Fwank is pushing through the house are two turds floating in my punchbowl are harshing my pre-Yule buzz.

One can take solace in the fact that TEH WON is on a greased slide to oblivion based on the Raz D.T. (-19% today) and it is only going to get worse.

All of that having been said, Cliff, Merry Christmas and a Happy New Year to you and your readers.

I'm inclined to disagree with just a conservative girl. I don't agree that the ACORN funding ban is a Bill of Attainder. It would be if it invoked a fine or sentence of some sort for its malfeasance, but I don't see how cutting off public funding amounts to an attempt to co-opt a judicial function by the Congress. It's a fiscal policy decision. I hope the government appeals this decision, but given the Attorney General's predilections, this is doubtful.

I could be talking out of my hat, of course. My legal reasoning might be more aptly called wishful thinking.
