Looking Good! New Photos of Gabrielle Giffords

Politico: Rep. Gabrielle Giffords were posted early Sunday on her Facebook page, two photos that show her with shorter, darker hair but few signs that she suffered a gunshot wound to the head.

The photos were taken May 17 outside the Houston rehabilitation facility where Giffords has been undergoing intensive treatment since she was wounded five months ago at a meet-and-greet event with constituents. Six people died and a dozen others were wounded in the Jan. 8 attack in Tucson, Ariz. 

Since then, access to the Arizona congresswoman has been tightly controlled. Until Sunday, no clear images had been released.[...]

Giffords spokesman C.J. Karamargin said staff members released the photos Sunday to help satisfy “intense interest in the congresswoman’s appearance.”

Because Giffords could be released later this month, her staff worried that her upcoming outpatient treatment could expose her more to public settings and unwanted photography.
“What we wanted to avoid was a paparazzi-like frenzy, and that’s why the photos are being made public,” Karamargin said. [MORE]

I think it was a good idea to release the photos now. Curiosity about her appearance would only intensify as time goes on. Now that the public has an idea what she looks like now, the need to know will be diminished.

I must say, all those prayers for her recover have paid off. You can still see Gabby in the new pics. Once her hair grows back in, she should resemble her old self with little evidence of have taken such a severe would. God, is clearly smiling on this family.

Video: Governor Jan Brewer freezes up during debate

Ouch! That was painful to watch. I bet Jan Brewer made the mistake of memorizing her opening statement.  If so, I think that was a silly thing to do. She knows what she has accomplished, all she had to do is just give a warm hello and tick off her accomplishment.

Whenever, I had to speak publicly, I never memorized my words verbatim. Instead I memorized the flow I wanted to follow and filled in the rest from my own knowledge.  It is far more flexible and easier thing to do.

In the end, I don’t think this stumble will matter much.  Brewer’s actions are well known and the public already has an opinion of her. Had this been Brewer’s first time meeting the public, she would have been toast.

Judge Bolton’s ruling on Arizona’s Immigration Law SB 1070

Of course by now you have all heard about U.S. District Judge Susan Bolton’s rulings on Arizona’s Immigration Law SB 1070.  I see this ruling as a major blow to state’s ability to police their borders.

Bolton’s worse decision was saying that Arizona’s police cannot check on immigration status after a person is arrested for something else. 

The Court first addresses the second sentence of Section 2(B): “Any person who is arrested shall have the person’s immigration status determined before the person is released.”

Arizona advances that the proper interpretation of this sentence is “that only where a reasonable suspicion exists that a person arrested is an alien and is unlawfully present in the United States must the person’s immigration status be determined before the person is released.” (Defs.’ Resp. to Pl.’s Mot. (“Defs.’ Resp.”) at 10.) Arizona goes on to state, “[T]he Arizona Legislature could not have intended to compel Arizona’s law enforcement officers to determine and verify the immigration status of every single person arrested – even for United States citizens and when there is absolutely no reason to believe the person is unlawfully present in the country.” (Id.)

The Court cannot interpret this provision as Arizona suggests. Before the passage of H.B. 2162, the first sentence of Section 2(B) of the original S.B. 1070 began, “For any lawful contact” rather than “For any lawful stop, detention or arrest.” (Compare original S.B. 1070 § 2(B) with H.B. 2162 § 3(B).) The second sentence w s identical in the original version and as modified by H.B. 2162. It is not a logical interpretation of the Arizona Legislature’s intent to state that it originally intended the first two sentences of Section 2(B) to be read as Section 2(B) are clearly independent of one another. Therefore, it does not follow logically that by changing “any lawful contact” to “any lawful stop, detention or arrest” in the first sentence, the Arizona Legislature intended to alter the meaning of the second sentence in any way. If that had been the Legislature’s intent, it could easily have modified the second sentence accordingly." 

I just don’t see how Bolton makes this argument, when states already check people for a variety of other reasons after they are arrested (e.g. outstanding warrants, outstanding taxes and fines, etc). What makes immigration status so special that it should not be checked?

Judge Bolton’s concern about 4th Amendment issues also makes little sense to me. 

Requiring Arizona law enforcement officials and agencies to determine the immigration status of every person who is arrested burdens lawfully-present aliens because their liberty will be restricted while their status is checked. Given the large number of people who are technically “arrested” but never booked into jail or perhaps even transported to a law enforcement facility, detention time for this category of arrestee will certainly be extended during an immigration status verification. 

Permanent Residents are requited to carry their id cards at all times: 

Legal Definition of Permanent Resident Card: United States permanent residents have an identification card known as the “Permanent Resident Card.” The Permanent Resident Card is also known as are the immigrant visa, permanent visa, Green Card, permanent resident visa, and form I-551 or form I-551. While permanent residents are not United States citizens, they are granted permission to reside and work in the United States on a permanent basis. Before the terrorist attacks of September 11 2001, the requirement to carry the Permanent Resident Card at all times was not strictly enforced. Previously, permanent resident cards were usually only checked when traveling outside the United States. However, now the U.S. Department of Homeland Security (DHS) requires that permanent residents of the United States be prepared to show their Permanent Resident Card at all times. DHS also requires that all permanent residents of the United States who are traveling to show their Permanent Resident Card or other documentation that will prove their legal status in the country.  

So where is this burden to lawfully-present aliens that Bolton speaks of?  Is she suggesting that even the Feds drop this requirement? Bolton’s rulings will no doubt be challenged and we will see this case wind its way up to the Supreme Court.

Democratic governors find the administration’s immigration lawsuit “toxic”

The Obama administration’s lawsuit against Arizona’s illegal immigration law isn’t sitting pretty with a lot of Democratic governors. 

New York Times: In a private meeting with White House officials this weekend, Democratic governors voiced deep anxiety about the Obama administration’s suit against Arizona’s new immigration law, worrying that it could cost a vulnerable Democratic Party in the fall elections.

While the weak economy dominated the official agenda at the summer meeting here of the National Governors Association, concern over immigration policy pervaded the closed-door session between Democratic governors and White House officials and simmered throughout the three-day event.

At the Democrats’ meeting on Saturday, some governors bemoaned the timing of the Justice Department lawsuit, according to two governors who spoke anonymously because the discussion was private.

“Universally the governors are saying, ‘We’ve got to talk about jobs,’ ” Gov. Phil Bredesen of Tennessee, a Democrat, said in an interview. “And all of a sudden we have immigration going on.”

He added, “It is such a toxic subject, such an important time for Democrats.”

The administration seemed to be taking a carrot-and-stick approach on Sunday. Homeland Security Secretary Janet Napolitano, in town to give the governors a classified national security briefing, met one-on-one with Jan Brewer, the Republican who succeeded her as governor of Arizona and ardently supports the immigration law.

About the same time as that meeting, Attorney General Eric H. Holder Jr. said on a taped Sunday talk show that the Justice Department could bring yet another lawsuit against Arizona if there is evidence that the immigration law leads to racial profiling.

The administration is working on its own agenda. That agenda has nothing to do with what is actually going on with the nation. Jobs, the economy and our national debt are crying out for attention, yet this administration is only focused on creating everlasting leftwing change and nothing more.

With five months to go before a new Congress takes over, I expect this administration to do everything and anything to foist their agenda down our throats and damn the concerns of everyone including the Democrat Party. 

This is why it is beyond crucial that when Republicans take over, they stand firm against “hope and change”. None of that silly compromise nonsense and no running like cowards at the first sign on demonizing.

Game On! Administration To Challenge Arizona Law

CBS News: It was unclear yesterday whether Clinton's comments were simply a prediction or mistake or whether instead she was getting ahead of a planned announcement by the administration.

Now a senior administration official tells CBS News that the federal government will indeed formally challenge the law when Justice Department lawyers are finished building the case. The official said Justice is still working on building the case. 

The administration is going to lose this lawsuit.  The Arizona law is basically a lesser version of the Federal law. The only real difference is that Arizona actually intends to enforce their law.

Obama is obviously bringing this losing lawsuit to gain more misguided Hispanic support for the Democratic Party and he will be successful to a certain degree.  However, an Arizona win will most likely lead to other border states copying Arizona’s law (save the nut jobs in California).  Furthermore an Arizona win will propel Governor Jan Brewer from mere rock star status in the GOP to The Palin League (Palin/ Brewer 2012, anyone?).

It will be interesting to see just what angle of attack the administration plans to use to challenge Arizona. I think they will try the civil rights angle to make it look good. I am also curious if Eric Holder will handle the matter himself. He is getting pretty good at humiliating himself in public.

Hillary Spills The Beans: Obama Administration Filing Lawsuit Against Arizona Law

Well how is that for some straight talk? The administration has made it perfectly clear it does not like Arizona’s immigration law, even though no one in the administration seems to have read it. To date, the administration has only said they would look into the law but nothing about filing a lawsuit. 

I wonder if Hillary simply let this fly because she thought it would be safe to disclose abroad or is this another one of the administration’s lame trial balloons? Hard to tell, since the Justice Department won’t confirm or deny Hillary’s remark.

Governor Brewer is livid and rightfully so.

Brewer's statement said she was "stunned and angered" by Clinton's statement that a lawsuit would be filed.

"To learn of this lawsuit through an Ecuadorean interview with the Secretary of State is just outrageous," Brewer said in the statement. "If our own government intends to sue our state to prevent illegal immigration enforcement, the least it can do is inform us before it informs the citizens of another nation."

Governor Brewer should not be the least bit surprised. Duplicity is a cornerstone in this administration. They are firm believers in saying one thing and doing another.

It will be interesting to see if Obama and crew actually follow through with this lawsuit. The most recent polls clearly indicate that the majority of Americans favor Arizona’s approach to immigration. To bring an lawsuit and not have an equally popular plan of action on the Federal level, will mean more hardship for Democrats come November.

Head of ICE won’t process Arizona’s illegals

This was a stunning twist in the administration’s war against Arizona. The head of ICE (Immigration Customs and Enforcement) John Morton has stated that he doesn’t care of Arizona’s law and that his agency may not process illegal aliens sent to them from Arizona.

Fox News: A top Department of Homeland Security official reportedly said his agency will not necessarily process illegal immigrants referred to them by Arizona authorities.

John Morton, assistant secretary of homeland security for U.S. Immigration and Customs Enforcement, made the comment during a meeting on Wednesday with the editorial board of the Chicago Tribune, the newspaper reports.

"I don't think the Arizona law, or laws like it, are the solution," Morton told the newspaper.

The best way to reduce illegal immigration is through a comprehensive federal approach, he said, and not a patchwork of state laws.

Judge Andrew Napolitano says that Morton can choose to ignore illegals referred to them from Arizona:

Fox News legal analyst Judge Andrew Napolitano said ICE is not obligated to process illegal immigrants referred to them by Arizona authorities.

"ICE has the legal discretion to accept or not to accept persons delivered to it by non-federal personnel," Napolitano said. "It also has the discretion to deport or not to deport persons delivered to it by any government agents, even its own."

John Morton is an attorney who has worked for the Justice Department in the past. I am pretty sure he found this loophole for the administration.  As a former Justice Department attorney, Morton must also be quite aware that Arizona’s law is weaker than the Federal standards.  In this clip from The Factor, Megyn Kelly spells out the difference between Arizona’s law and the Fed's.  At the end of the clip, Kelly and Bill O’Reilly ask why the Obama administration is hell bent of fighting Arizona’s law.

I think I have the answer why Obama is doing this. It is no secret that Obama and the Democrats want amnesty. They need amnesty to replenish all the independent voters they have permanently lost with their overspending and deaf ear to the will of the people. Should Arizona’s law ever catch on with the other border states, that vast supply of illegal aliens (i.e. new voters) would rapidly dry up. So what to do? What Democrats always do with those who stand in their way, demonize, demonize, demonize.

I am not sure Obama and the Democrats will be successful with this.  The numbers constantly show that the majority of Americans stand with Arizona. Just today, Rasmussen has a new poll showing that 68% of Americans oppose boycotts of Arizona. Furthermore, Arizona’s governor Jan Brewer is nobody’s bitch.  She is more than willing to go toe to toe with this administration. Just look at her new ad from SecuretheBorder.org.

If the administration keeps this up, Jan Brewer may just expose them for the corrupt-o-crats they really are.

Democrats give lying hypocrite Felipe Calderona standing ovation

I thought Obama joining Mexican President Felipe Calderon in bashing Arizona was bad enough, but today’s spectacle in Congress takes the cake. Democrats squeal whenever the right accuses them of being American haters, but when you see them spring to their feet to applaud that lying hypocrite Calderon what else can you conclude?

Thankfully some Republicans spoke up about Calderon’s BS, Orin Hatch said: 

 “It’s inappropriate for a head of state to question our laws, especially when the state of Arizona only acted in the best interest of its citizens and with the support of seventy percent of its people,” said Hatch in a statement. 

“The state of Arizona is stepping in where the federal government has failed,” said Hatch. “It is trying to stop waves of illegal immigrants, many of whom are dangerous gang members and drug and human traffickers, from crossing into its communities." 

Hatch could have been much for forceful here. There is little need to sugar coat Calderon’s lies and hypocrisy.  I guess we will have to wait for a female Republican to say what needs to be said.

What I don’t understand about the Democrat’s continued stance against Arizona’s law is that it is a political loser. Just today, Rasmussen has released a new poll showing that Arizonans have increased their support for the law from 67% to 71%.  Even nationally, the majority of Americans support what Arizona is doing. 

Fox News: A Fox News poll finds 65 percent of American voters think states should have right to make their own immigration laws and protect their borders “if they believe the federal government has failed to act,” while 32 percent disagree. Moreover, a 52 percent majority favors their own state passing a bill similar to Arizona’s new immigration law. Some 31 percent would oppose it and another 18 percent is unsure…

The key provisions of Arizona’s immigration law receive significant support. Over two-thirds (65 percent) favor allowing local authorities to question anyone who they think may be in the country illegally, while 76 percent favor allowing local officials to detain anyone who cannot prove their immigration status.

Rasmussen also found that most Americans blame Mexico for our immigration woes and think compensation is in order: 

Obama and President Felipe Calderon of Mexico denounced the Arizona law at a joint White House press conference yesterday. But most Americans don’t believe Mexico wants to stop the illegal flow of its citizens into this country and think America’s southern neighbor should be asked to compensate U.S. taxpayers for costs incurred by illegal immigration. 

So why are Democrats taking their stance. With numbers like these on such a hot button issue, even winning the Hispanic vote won’t save them.

Mexican President Felipe Calderon bashes Arizona’s immigration law from White House lawn

I find this incident beyond infuriating. If ever there was truly an example of how broken Washington has become this is it.

First, we have a president who is deliberately stirring the racial pot for political gain. Anyone who is willing to take 10 minutes to actually read Arizona’s law, will immediately see that there is no racial profiling or possibility for it to happen.

Second, we have the Mexican president, who does little next to nothing to combat illegal immigration from his side of the border, standing on our soil and treating us like the bad guys. To add insult to injury, Mexico’s immigration laws are 100 times more draconian than anything found in America. Despite these facts, not a single official from this farce of an administration even calls Calderon out on his blatant hypocrisy.

Finally, despite the high level of hypocrisy from Calderon, our own president who is supposed to have our backs, is out there joining in on the bashfest with Calderon. There was a time here in America when Obama’s actions would have deservedly earned him the title “traitor”. 

If Obama were truly serving America’s best interest, he would have had a closed-door session with Calderon. During that session Obama would have administered some long over due tough love to our southern neighbor. Obama should have in no uncertain terms let Calderon know that the days of shuffling off their unhappy citizens to America is over. Tell Calderon we are securing our southern border as tight as a drum and if the Mexican government doesn't start seriously looking after the needs of its people, America would engage in the most massive deportations this country has ever seen. The last thing Mexico wants is a massive influx of its former unhappy citizens. Without a way to sneak back into the US, these unhappy souls would finally bring the much needed pressure to the Mexican government to change its ways.

Given how the numbers are running against Obama on illegal immigration, he is playing with fire. Sarah Palin alone will crucify him for not sticking up for America during Calderon’s BS and in this case it will be well deserved.

Moral Equivalence Run Amok: US apologizes to China for Arizona law

One of the left’s worst habits is moral equivalence. They take a moral issue and try to equate it to some of the worst things in the world. For example, they say Arizona's law is equal to Nazi Germany.  These over the top comparisons are bad enough when practiced by the leftwing masses at home, but when our own State Department gets into the act when dealing with China, we have hit a new low. 

Powerline: This is unfreakingbelievable, even for the Obama administration:

The United States and China reported no major breakthroughs Friday after only their second round of talks about human rights since 2002.

The Obama administration wants to push Beijing to treat its citizens better, but it also needs Chinese support on Iranian and North Korean nuclear standoffs, climate change and other difficult issues. ...

[Assistant Secretary of State Michael] Posner said in addition to talks on freedom of religion and expression, labor rights and rule of law, officials also discussed Chinese complaints about problems with U.S. human rights, which have included crime, poverty, homelessness and racial discrimination.

He said U.S. officials did not whitewash the American record and in fact raised on its [sic] own a new immigration law in Arizona that requires police to ask about a person's immigration status if there is suspicion the person is in the country illegally.

What an idiot! China murdered millions of its citizens who opposed the government's Communist policies and allows most of its people little or no freedom. We, on the other hand, enforce our immigration laws. No, wait--actually we don't. That's why Arizona had to take a shot at it. Oh, by the way, Michael Posner, you clueless moron--China actually does enforce its immigration laws.

Did you notice that China did not bring up the Arizona law?  It was this asshat Michael Posner (Michele Malkin has the lowdown on this bozo) who brought it up early and often.   Posner is another idiot in this administration who did not bother to read Arizona’s 17-page law. The left hates when the right accuses them of hating America, but when you get examples like this what else is one to conclude?

Following the discovery of the infected Mexican man, authorities quarantined 70 Mexicans who arrived in China over the May 1 holiday weekend, most on different flights from the infected man. They include an official at Mexico’s consulate in Guangzhou who was returning on a flight from Southeast Asia. Except for the initial case, none of the 70 has shown symptoms of the disease, says a spokesperson from the embassy. Now concerns are being raised that Mexicans are being isolated solely because of their nationality.

Mexico’s Foreign Minister, Patricia Espinosa, called the treatment of the Mexicans in China discriminatory and said some of the quarantined travelers were being held in “unacceptable conditions.” On May 3, Mexico’s ambassador to China, Jorge Guajardo, attempted to visit 10 Mexicans who are in quarantine at Guomen Hotel in suburban Beijing, but he was denied access. As of Monday morning, he still hadn’t been able to gain access to the group. Over the Mexican government’s objections, China has decided to halt all AeroMexico flights coming into China. On Monday evening, the Chinese Foreign Ministry posted a brief announcement on its website saying that China and Mexico had planned for charter flights to return stranded nationals from the two countries, but no details were provided.

On Monday, Chinese Foreign Ministry spokesman Ma Zhaoxu denied that Mexicans were being singled out. “These measures are not aimed at Mexican citizens, and are not discriminating in nature. The issue is purely a matter of public health and quarantine inspection,” Ma said in a statement on the ministry’s website. “China understands Mexico’s concern for its citizens in China, but we hope Mexico could focus on the bigger picture of fighting against the epidemic … and deal with the issue in an objective and calm way.”

And we’re apologizing for profiling to the same country that did this?  Those travelers entered China legally.

I for one am too through with these apology tours. Yes, America has some faults, but the idea that our faults are equal to China’s human rights abuses is beyond ignorant. Why does the left refuse to weigh the good that America has brought to the world against its faults? It is almost like all the left can see are America’s faults and then magnify those faults to the level of the world’s greatest abusers. Is it that they secretly wish America was that bad so that they can paint themselves as heroes saving the world or is it what we on the right always suspected, they simply hate America?

Arizona governor Jan Brewer is not taking the smears and boycotts lying down. After releasing a blistering ad telling Obama to do his job and secure the borders, Brewer with Palin have released this new ad. In this new ad, Obama’s flunkies Eric Holder and Janet Napolitano used as prime examples of Washington's ineptitude on the border issue.

How many times can Eric Holder make a fool of himself?

I have lost count of the number of times Eric Holder has made a fool of himself in front of Congress. I am not sure if it is because he is trying to get the law to support Obama’s wrong headed policies or is it because Holder himself is a stone cold ideologue who refuses to bend to reality. Either way, the man comes off as one big fool and yesterday Holder acted the fool twice!

Acting the fool, Scene One:

Here is Eric Holder’s response to Rep. Ted Poe’s (R-TX) direct question "Have you read the Arizona law?"

You must be joking, the bill in only 17 pages long, how many people are needed to review it? As the Attorney General of the United States, Holder should be able to read and review that tiny law himself inside the time of a coffee break. To make matters worse, Holder is on record attacking the bill, he now admits to never reading.

Whatever the cause is behind Eric Holder’s foolishness, we as a nation will be the ones to suffer for it. If Obama were half the chief executive he pretends to be, he would have asked for Holder’s resignation right after Lindsey Graham made a fool of him.

Arizona passes law that puts restrictions on ethnic studies

It looks like leftwing demagoguery has no effect on Arizona. After two months of the left saying that Arizona’s new immigration law is racist, Arizona’s governor signed into law a bill that puts restrictions on ethnic studies courses. 

Politico: Arizona GOP Gov. Jan Brewer has signed a law banning the state’s schools from teaching ethnic studies classes.

Brewer signed the bill Tuesday that targets Chicano studies programs currently being taught in Tucson schools. […]

The law prohibits the teaching of any classes that promote “the overthrow of the United States government,” “resentment toward a race or class of people,” “are designed primarily for pupils of a particular ethnic group” or “advocate ethnic solidarity instead of the treatment of pupils as individuals.” 

Considering how Arizona’s immigration bill (SB1070) was so incorrectly reported, I decided to look this one up myself. Here is HB2281 (the bill also contains new guidelines for student disciplinary action). Below are the parts of the bill that pertain to ethic studies

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding sections 15-111 and 15-112, to read:

15-111.  Declaration of policy

THE LEGISLATURE FINDS AND DECLARES THAT PUBLIC SCHOOL PUPILS SHOULD BE TAUGHT TO TREAT AND VALUE EACH OTHER AS INDIVIDUALS AND NOT BE TAUGHT TO RESENT OR HATE OTHER RACES OR CLASSES OF PEOPLE.

15-112.  Prohibited courses and classes; enforcement

A.  A SCHOOL DISTRICT OR CHARTER SCHOOL IN THIS STATE SHALL NOT INCLUDE IN ITS PROGRAM OF INSTRUCTION ANY COURSES OR CLASSES THAT INCLUDE ANY OF THE FOLLOWING:

1.  PROMOTE THE OVERTHROW OF THE UNITED STATES GOVERNMENT.

2.  PROMOTE RESENTMENT TOWARD A RACE OR CLASS OF PEOPLE.

3.  ARE DESIGNED PRIMARILY FOR PUPILS OF A PARTICULAR ETHNIC GROUP.

4.  ADVOCATE ETHNIC SOLIDARITY INSTEAD OF THE TREATMENT OF PUPILS AS INDIVIDUALS.

B.  IF THE STATE BOARD OF EDUCATION OR THE SUPERINTENDENT OF PUBLIC INSTRUCTION DETERMINES THAT A SCHOOL DISTRICT OR CHARTER SCHOOL IS IN VIOLATION OF SUBSECTION A, THE STATE BOARD OF EDUCATION OR THE SUPERINTENDENT OF PUBLIC INSTRUCTION SHALL NOTIFY THE SCHOOL DISTRICT OR CHARTER SCHOOL THAT IT IS IN VIOLATION OF SUBSECTION A.  IF THE STATE BOARD OF EDUCATION OR THE SUPERINTENDENT OF PUBLIC INSTRUCTION DETERMINES THAT THE SCHOOL DISTRICT OR CHARTER SCHOOL HAS FAILED TO COMPLY WITH SUBSECTION A WITHIN SIXTY DAYS AFTER A NOTICE HAS BEEN ISSUED PURSUANT TO THIS SUBSECTION, THE STATE BOARD OF EDUCATION OR THE SUPERINTENDENT OF PUBLIC INSTRUCTION MAY DIRECT THE DEPARTMENT OF EDUCATION TO WITHHOLD UP TO TEN PER CENT OF THE MONTHLY APPORTIONMENT OF STATE AID THAT WOULD OTHERWISE BE DUE THE SCHOOL DISTRICT OR CHARTER SCHOOL.  THE DEPARTMENT OF EDUCATION SHALL ADJUST THE SCHOOL DISTRICT OR CHARTER SCHOOL'S APPORTIONMENT ACCORDINGLY.  WHEN THE STATE BOARD OF EDUCATION OR THE SUPERINTENDENT OF PUBLIC INSTRUCTION DETERMINES THAT THE SCHOOL DISTRICT OR CHARTER SCHOOL IS IN COMPLIANCE WITH SUBSECTION A, THE DEPARTMENT OF EDUCATION SHALL RESTORE THE FULL AMOUNT OF STATE AID PAYMENTS TO THE SCHOOL DISTRICT OR CHARTER SCHOOL.

C.  THE DEPARTMENT OF EDUCATION SHALL PAY FOR ALL EXPENSES OF A HEARING CONDUCTED PURSUANT TO THIS SECTION.

D.  ACTIONS TAKEN UNDER THIS SECTION ARE SUBJECT TO APPEAL PURSUANT TO TITLE 41, CHAPTER 6, ARTICLE 10.

E.  THIS SECTION SHALL NOT BE CONSTRUED TO RESTRICT OR PROHIBIT:

1.  COURSES OR CLASSES FOR NATIVE AMERICAN PUPILS THAT ARE REQUIRED TO COMPLY WITH FEDERAL LAW.

2.  THE GROUPING OF PUPILS ACCORDING TO ACADEMIC PERFORMANCE, INCLUDING CAPABILITY IN THE ENGLISH LANGUAGE, THAT MAY RESULT IN A DISPARATE IMPACT BY ETHNICITY.

3.  COURSES OR CLASSES THAT INCLUDE THE HISTORY OF ANY ETHNIC GROUP AND THAT ARE OPEN TO ALL STUDENTS, UNLESS THE COURSE OR CLASS VIOLATES SUBSECTION A.

4.  COURSES OR CLASSES THAT INCLUDE THE DISCUSSION OF CONTROVERSIAL ASPECTS OF HISTORY.

F.  NOTHING IN THIS SECTION SHALL BE CONSTRUED TO RESTRICT OR PROHIBIT THE INSTRUCTION OF THE HOLOCAUST, ANY OTHER INSTANCE OF GENOCIDE, OR THE HISTORICAL OPPRESSION OF A PARTICULAR GROUP OF PEOPLE BASED ON ETHNICITY, RACE, OR CLASS.

Notice the restrictions E and F at the end. While some are quick to ridicule the bill, there were two examples in the nation recently that this bill would seem to address. That black only field trip certainly would have run right into this law and that UCLA professor who was advocating the downfall of capitalism via revolution. So it isn’t like the thing this bill addresses don’t or can’t happen.

Pew Research: Broad approval for Arizona’s Immigration Law

Given the heavy-duty smear job the Democrats have employed against Arizona’s new immigration law, these are beyond impressive numbers.

The Pew Research Poll also provided some more startling news, a good deal of Democrats support it too.  Notice that a majority of Democrats support each provision.

So if most Americans are supportive of Arizona’s law, including a healthy number of Democrats, what is the benefit to smearing the law? For that answer we turn to this Wall Street Journal poll that finds most Hispanics disapprove of the law. 

By a two-to-one margin Hispanics are more strongly opposed than Americans overall to the recent immigration measure signed in to law in Arizona that would make it a state crime to reside there illegally.

Seven in 10, 70%, of Hispanic respondents said they are somewhat or strongly opposed to the law, compared with 34% of all respondents in the latest Wall Street Journal/NBC News poll set for release later today.

Among Hispanics, 27% are somewhat or strongly supportive of Arizona’s law; that compares with 64% of respondents overall.

Hispanics’ opposition to the law stems from a widely held concern that it will lead to discrimination towards Hispanics who are citizens, or who are residing in the U.S. legally. Fully 82% of Hispanics said they are concerned about profiling, compared with 66% overall.

Basically what the Democrats are trying to do with Arizona's law, is to strengthen their support among Hispanics just in time for the midterms. Now will Hispanics flock to the poll in November out of fear? I have my doubt. 2012 on the other hand could be a different story. Fortunately, we have two years to make sure everyone actually reads the bill.
