Head of ICE won’t process Arizona’s illegals


This was a stunning twist in the administration’s war against Arizona. The head of ICE (Immigration Customs and Enforcement) John Morton has stated that he doesn’t care of Arizona’s law and that his agency may not process illegal aliens sent to them from Arizona.
Fox News: A top Department of Homeland Security official reportedly said his agency will not necessarily process illegal immigrants referred to them by Arizona authorities.
John Morton, assistant secretary of homeland security for U.S. Immigration and Customs Enforcement, made the comment during a meeting on Wednesday with the editorial board of the Chicago Tribune, the newspaper reports.
"I don't think the Arizona law, or laws like it, are the solution," Morton told the newspaper.
The best way to reduce illegal immigration is through a comprehensive federal approach, he said, and not a patchwork of state laws.
Judge Andrew Napolitano says that Morton can choose to ignore illegals referred to them from Arizona:
Fox News legal analyst Judge Andrew Napolitano said ICE is not obligated to process illegal immigrants referred to them by Arizona authorities.
"ICE has the legal discretion to accept or not to accept persons delivered to it by non-federal personnel," Napolitano said. "It also has the discretion to deport or not to deport persons delivered to it by any government agents, even its own."
John Morton is an attorney who has worked for the Justice Department in the past. I am pretty sure he found this loophole for the administration.  As a former Justice Department attorney, Morton must also be quite aware that Arizona’s law is weaker than the Federal standards.  In this clip from The Factor, Megyn Kelly spells out the difference between Arizona’s law and the Fed's.  At the end of the clip, Kelly and Bill O’Reilly ask why the Obama administration is hell bent of fighting Arizona’s law.



I think I have the answer why Obama is doing this. It is no secret that Obama and the Democrats want amnesty. They need amnesty to replenish all the independent voters they have permanently lost with their overspending and deaf ear to the will of the people. Should Arizona’s law ever catch on with the other border states, that vast supply of illegal aliens (i.e. new voters) would rapidly dry up. So what to do? What Democrats always do with those who stand in their way, demonize, demonize, demonize.

I am not sure Obama and the Democrats will be successful with this.  The numbers constantly show that the majority of Americans stand with Arizona. Just today, Rasmussen has a new poll showing that 68% of Americans oppose boycotts of Arizona. Furthermore, Arizona’s governor Jan Brewer is nobody’s bitch.  She is more than willing to go toe to toe with this administration. Just look at her new ad from SecuretheBorder.org.


If the administration keeps this up, Jan Brewer may just expose them for the corrupt-o-crats they really are.

And Sheriff Joe said he will "put up tents from [Phoenix] to Mexico" to detain any illegals that ICE won't take.

AZ is not going to back down and the harder the progressives push, the harder we'll push back.

while that is true, you assume the illegals will be loyal to the democratic party, the problem is in my opinion the democratic party over estimated what will happen, I think the number of illegals is low ball at 12 million more like 50 million, how many people voted for Clinton, Bush, McCain or Obama. I my humble opinion I think if they get immigration reform really amnesty with in a year you will see extension of the political parties in Mexico show up in the southern states and soon expand to the northern states.

If they won't do their job, then I guess there's not much need for that department and, hence, FUNDING for that department, right?

Shut 'em down. Cut off the pipeline of funds feeding the beast.

I still believe the illegals will most vote Democrat because as you noticed, the Democrats are stirring the racial pot as well. Just like they do with blacks, the Democrats will paint themselves as racial saviors.

I do agree that we will see more of Mexico's political parties exerting influence in our border states. So many of the illegals have not adopted America.

This will be devastating to the administration if they follow this path- The only solution for them is to sign into law some form of amnesty so that they do not pay for the trespass of American laws. I do see this happening because they will be successful (IMO) b/c of the weak Repubs and they will then use the Federal moneys transferred through stimulus to bus new voters to the polls.

It's a sorry situation for this country.

While I believe it is true that the amnesty recipients will vote with the Democratic party, their vote will be for "MEXICAN" or Hispanic Democrats and the "existing" incumbents will be voted out! I'm sure they haven't thought this one through.
