Game On! Administration To Challenge Arizona Law

CBS News: It was unclear yesterday whether Clinton's comments were simply a prediction or mistake or whether instead she was getting ahead of a planned announcement by the administration.
Now a senior administration official tells CBS News that the federal government will indeed formally challenge the law when Justice Department lawyers are finished building the case. The official said Justice is still working on building the case.
The administration is going to lose this lawsuit.  The Arizona law is basically a lesser version of the Federal law. The only real difference is that Arizona actually intends to enforce their law.

Obama is obviously bringing this losing lawsuit to gain more misguided Hispanic support for the Democratic Party and he will be successful to a certain degree.  However, an Arizona win will most likely lead to other border states copying Arizona’s law (save the nut jobs in California).  Furthermore an Arizona win will propel Governor Jan Brewer from mere rock star status in the GOP to The Palin League (Palin/ Brewer 2012, anyone?).

It will be interesting to see just what angle of attack the administration plans to use to challenge Arizona. I think they will try the civil rights angle to make it look good. I am also curious if Eric Holder will handle the matter himself. He is getting pretty good at humiliating himself in public.

Is this seriously happening? The Obama administration is actually going through with a lawsuit against what is actually FEDERAL law? This is beyond atrocious. This really is an example of garnering votes from an entire race in light of the actual issue; illegals. It's sad to see how shameless this administration has become. I'm black, and I consider myself a moderate leaning right. I understand how other blacks have faithfully contributed their votes to the Democratic party, but don't agree with it. Things like this are going to make the November elections a blood bath for Dems.

You know what's interesting about this? That TRS got the news up, presumably before it was intended to be released. Therefore, they had to announce it now....my guess is that they were saving it for before the elections to get the story in the media cycles and demonize Republicans at election time.

It sounds very conspiratorial, but I put nothing beyond their tactics.

I do agree that it seems likely lose this, but the federal government is very powerful and whatever pressures they can exert will be used.

With any luck, Hispanic folks will wake up and smell the coffee, realizing that Obama and so many of those on the left really don't give a shit about them, just using them as political pawns to be discarded when no longer convenient, kind of like they've used women, blacks, and gays.

I think that this is a good thing. It will be settled this way. I also believe that they know they are going to fail and are doing this for political purposes only. Wow, that is good use of our tax dollars huh?

I thought the Arizona law mirrored federal law, which isn't being enforced, but goes even further to prohibit profiling. I'm just wondering how Holder will challenge it, with this being the case. Any lawyers here that might be able to expand on this?

I don't understand how police asking if someone is in this country legally violates their civil rights. If you're here legally then you shouldn't have a problem proving it.

The DNC makes a strategic error in decrying this law. Most Hispanics already vote Democratic. This won't bring new voters, but will alienate the independents who are among the 75+% of Americans who support AZ. You're right, the federal government will lose. I'm hoping this is part of the house of cards that the Dems are building for themselves. If that's the case, then - as you said - bring it on.

Actually, the angle they are going to use is the 'interference with federal law enforcement' angle'. The reason he has agreed to send National Guard is assistance is to make it look like the fed is doing something.
Depending on where the fed files, they may be able to get an injunction from a friendly court to temp stop the enforcing of the AZ law. However, anything the fed does will fail, not only on law, but merit. How can you surrender American soil to Mexico due to your lack of interest in enforcing the law, then make a justifiable claim that others are preventing enforcement. Only in liberal bizarro World :-)

I cannot believe that the Federal government is really taking on a state government because it is, in effect, helping it do its job.

this is going to be interesting, since the law suit will go directly to the supreme court.

You have to remember, If King Barrack gets it all the way to the Supreme Court, he's got it stacked in his favor now.

..not yet, George, Kagan is a lo-o-o-o-o-n-g way from being vetted and there are some ugly things cropping up that promise to make the approval process drag on and on and on.

The Right Girl:

That never even crossed my mind- you're right about the fact that they already have the majority of that voting group and that the independents may make the difference-

BUT, I still think that most people don't know any more that what they hear from their local news (which provides cover) tells them, and so I don't know that they will be swayed by any more than fancy political campaign talk whereas the Hispanic population has this huge barrier between them and the R candidate.

In the end this will all come back down to the entitlement mentality that is prevailing, and I think it is going to hurt conservatives.

If I were to predict, I would guess that whichever way the mid-terms go, the country will go in 2012.- I think it will be a disappointment to the Republican party.

Something to think about is the La Raza and Azatlan groups. Mexico wants to have a foot in the US, they want to claim the southern states back to Mexico. That's why Barak made that national park at the border off limits to Americans. He is giving bits of America back to Mexico, he wants to be president of the North American Union; Canada, US, and Mexico. So he doesn't care about the hispanics, he has other plans.
